EU guidance broadens AI Act disclosure duties

Enforcement of Article 50 of the EU AI Act went into effect on Aug. 2, 2026, with guidance that clarifies and solidifies obligations for enterprises using AI systems. The requirements may apply to more systems than organizations initially expected, particularly foundation model chatbots and AI-generated content.

The guidance requires transparent disclosure of AI interactions and machine-readable marking of synthetic outputs. Enterprises also need to prioritize chatbot notifications and deepfake labeling across legal, IT and business teams. Organizations face fines up to €15 million or 3% of global turnover for non-compliance, making near-term implementation a significant compliance concern.
